The trustee fee covers the licensed trustee’s ongoing work under its engagement. What is required for the annual renewal?

Annual renewal does not mean rewriting the trust deed each year. The governance review checks whether the existing documents and records remain consistent with current circumstances and the way the structure has operated.

If the underlying company is in Nevis or another jurisdiction, that jurisdiction’s current registry and provider schedule applies instead.

The annual review should reconcile the two ownership layers: the trust’s asset schedule and the LLC’s ownership register should describe the same interest in the legally correct form. Changes to managers, directors, signatories, registered office or ownership are handled through the company process and reflected in the wider trust records where relevant.

Banking, custody and transaction costs are activity-dependent

A trust or its underlying company may hold a bank, brokerage or custody account, but those accounts are not renewed by the FSC trust filing. Each institution sets its own account terms, maintenance charges, transaction fees and information requests.

At annual review, record the legal account holder, current signatories or dealing authorities, period-end statements and any significant transaction that also needs to appear in the trustee, company or accounting file. This gives the trustee and professional team a consistent picture without treating the bank statement as the whole trust record.

Home-country reporting is separate from the Cook Islands renewal

The Cook Islands renewal keeps the local registration current. It does not by itself complete the legal, tax or accounting work that may apply in another country.

For the United States, the Internal Revenue Service states that Form 3520 can apply to specified U.S. persons reporting certain foreign-trust transactions, ownership or distributions. The IRS also states that a foreign trust with a U.S. owner files Form 3520-A annually to provide information about the trust, its U.S. beneficiaries and persons treated as owners of part of the trust.
