That distinction explains most of the price variation in the market. Two firms quoting $8,000 and $20,000 for what looks like the same structure are usually not selling the same thing. Why a licensed trustee is unavoidable
At least one trustee must be a licensed Cook Islands trustee company under the Trustee Companies Act 2014 for the trust to qualify as an international trust under the International Trusts Act 1984. There is no self-administered option. Around ten firms currently hold this licence, each required to hold NZD 250,000 in paid-up capital, carry professional indemnity insurance, and submit principals to individual fit-and-proper assessment. Operating as a trustee without a licence is a criminal offence in the Cook Islands.

A trustee with no independent judgment is a trustee whose decisions a court can attribute to you, and that is what has decided every reported contempt case. Formation cost in year one

- Registration and government charges. Payable to the Cook Islands registry through the trustee. Amounts are set by regulation and updated periodically, so confirm current figures directly rather than relying on published guides.
- Due diligence and coordination. Certification of identity documents, source of wealth review, and managing the file between you, the trustee, and any adviser already acting for you.
What moves the number is complexity rather than asset value. A settlor with documented source of wealth, liquid assets, and a single country of residence sits at the bottom of the range. Multiple operating businesses, property in three countries, or wealth from a business sold a decade ago with incomplete records sits at the top.
Annual cost from year two
Ongoing cost is where offshore structures are most consistently underestimated at the point of sale. Budget $3,000 to $7,500 per year for trustee administration on a straightforward trust, plus government renewal charges. Trusts with operating businesses, multi-jurisdiction property, or frequent distributions sit above that range, often materially so.
The annual figure over the expected life of the structure is the right number to focus on. A trust expected to run twenty years at $5,000 per year is a $100,000 commitment before banking, tax advice, and distributions. That is the proper frame for deciding whether to proceed.

Ad valorem billing deserves particular attention. On a $5m trust at 0.2% that is $10,000 per year whether or not the trustee did anything beyond renewing the registration. On a $20m trust at 0.15% it is $30,000. For large, quiet portfolios this is almost always the worst-value model.
Under the fixed-plus-time model, what counts as routine decides your real annual cost. A trustee who bills time for every distribution request, every adviser letter, and every identity document update will cost materially more than the headline rate suggests. Ask for the definition in writing and for hourly rates by seniority, because a partner reviewing a routine request at $600 per hour changes the calculation.
Five costs outside the quote
These appear in almost every engagement and are included in very few initial quotes.
- An underlying company. Most trusts hold assets through an LLC rather than directly, so the settlor can manage investments without trustee approval of every trade. A Cook Islands LLC or Nevis equivalent adds formation cost plus an annual registered agent fee.
- Banking. Opening accounts for the trust or its company is a separate process: its own timeline, its own due diligence, and at some institutions its own charge. Minimum balances apply.
- Home-country tax advice and annual filings. A US settlor needs Forms 3520 and 3520-A annually. The penalty regime for errors is severe. Budget for a CPA with Cook Islands trust experience, not a general accountant learning on your file.
- Asset transfer costs. Conveyancing on real property, transfer agent fees on securities, valuations where the trustee requires one. These vary significantly by asset type and country.
- Exit costs. Terminating a trust or moving trustees carries fees from both the outgoing and incoming firm. Ask about exit at the start, while you have leverage.

Belize is consistently the cheapest and has the thinnest record of judicial testing. The two are the same fact stated differently. Nevada is cheaper than the Cook Islands and stays inside the reach of a sister-state court, which is the entire question its statute has not answered. What moves your number
Documentary history. A settlor who can evidence source of wealth with tax returns and sale agreements moves quickly. Wealth from a business sold a decade ago with incomplete records generates reconstruction work that somebody bills for.
Asset type and complexity. Cash and listed securities are straightforward. Private company shares need a valuation and shareholders agreement review. Real property needs conveyancing in the country where it sits. Cryptocurrency needs custody and provenance review, and not every trustee accepts it.
Number of jurisdictions. Each additional country adds local requirements, a currency, and at least one more professional to coordinate.
Deed complexity. A standard discretionary deed is quick. A deed with a protector committee, staged distributions, a Jones clause naming a known creditor, and charitable remainder provisions is a proper drafting exercise.
Urgency. Compressed timelines cost more and produce weaker structures. If you are paying for speed, examine whether the urgency is real or reflects a threat already close enough to weaken the structure timing position.
When the cost is not justified
We decline a meaningful number of enquiries. Four categories come up repeatedly.
Net worth below roughly one million dollars in exposed assets. Below that, annual administration costs consume a meaningful share of what is being protected, and domestic options cover most of the exposure at lower ongoing cost.
A claim already filed or formally threatened. A transfer at this stage faces a shorter limitation window, a stronger adverse inference from the timing, and a trustee who may decline outright. The right answer here is litigation counsel, not an offshore trust.
Assets that cannot practically move. A single owner-occupied home in a state with an unlimited homestead exemption is already better protected than an offshore trust can make it.
A settlor unwilling to give the trustee genuine authority. A trust the settlor still controls is the trust a court will set aside. If the purpose is to maintain practical control while appearing not to, the structure fails when tested and the cost to discover that is larger than the cost of not proceeding.
US annual reporting obligations
The Foreign Account Tax Compliance Act and the common reporting standard both treat a Cook Islands trust as a reportable foreign financial account. Beneficial owners, trustees and intermediaries all have separate obligations under these regimes. Understanding which obligation falls on you specifically requires advice from a qualified US tax attorney or CPA, and that advice belongs before the trust is settled rather than after the first filing deadline passes. The IRS has applied substantial penalties in cases where taxpayers treated foreign trust reporting as optional, and those penalties have survived challenge.
Forms 3520 and 3520-A are filed with the IRS each year by a US person who is the settlor of a foreign trust or who receives a distribution from one. The penalty for failing to file, or filing incorrectly, is the greater of $10,000 or 35 percent of the gross value of any distributions received. This is a material ongoing obligation. A CPA who prepares these forms regularly for Cook Islands trust clients should handle them. Budget $1,500 to $3,500 per year for competent preparation, depending on the complexity of the trust activity in the year.
Nevis LLC pairing
Most Cook Islands trusts hold assets through an underlying LLC rather than directly, and a Nevis LLC paired beneath the trust is a common arrangement. The trust owns the LLC, the settlor acts as manager within limits the trustee sets, and a creditor pursuing the assets meets the LLC charging-order limitation before reaching the trust level. Formation of a Nevis LLC runs $1,500 to $3,000. Annual registered agent fees run $500 to $1,000. Both sit outside the trust formation quote and should be confirmed during the scoping conversation.
